Viators Nursery Terms & Conditions

Last updated: August 27th 2026

Welcome to Viators Nursery. These Terms & Conditions apply when you visit our website, place an order, purchase products from us, or otherwise use our online store.

By using this website or placing an order, you agree to these Terms & Conditions. Please read them carefully before purchasing.

1. About us

This website is operated by Viators Nursery.

Throughout these Terms & Conditions, the words “we”, “us” and “our” refer to Viators Nursery. The words “you” and “your” refer to the customer, website visitor or person purchasing from us.

Our online store sells plants, bonsai starter plants, nursery stock and related products.

2. General information only

Any plant care information, growing tips, product descriptions, images, guides or recommendations provided on this website are general in nature. They are provided to help customers make informed choices, but they do not guarantee a particular result.

Plant performance can vary depending on climate, watering, light, soil, potting mix, fertiliser, pruning, pest management, transport conditions and ongoing care after delivery or collection.

3. Product availability

All products are subject to availability. As plants are living products, availability may change without notice due to seasonal growth, quality checks, weather, pest issues, damage, stock loss or other nursery conditions.

We may refuse, cancel or refund an order where a product is unavailable, incorrectly listed, damaged, unsuitable for sale, or otherwise unable to be supplied.

If this occurs, we will contact you using the details provided at checkout.

4. Product images and descriptions

We make reasonable efforts to display and describe our products accurately. However, plants are natural living products and may vary in size, shape, colour, leaf density, branching, flowering, trunk thickness, root development and overall appearance.

Product images may show an example plant only. Unless specifically stated, the exact plant pictured may not be the exact plant supplied.

Plant sizes, pot sizes and descriptions are approximate and may vary slightly.

5. Plant health and quality

We aim to supply healthy plants that are suitable for sale at the time they leave our nursery.

Because plants are living products, we cannot guarantee their ongoing health after delivery, collection or transfer to your care. Once a plant has been received, its ongoing condition depends on how it is handled, watered, positioned, repotted, fertilised and cared for.

Please inspect your order promptly when received and contact us as soon as possible if you believe there is an issue.

6. Orders

When you place an order, you agree that all information you provide is accurate, complete and up to date, including your name, contact details, delivery address and payment information.

An order is not accepted by us until payment has been received and the order has been confirmed.

We reserve the right to cancel or refuse an order where we reasonably believe there has been an error, misuse of the website, incorrect pricing, stock issue, delivery issue, suspected fraud or other genuine business reason.

7. Pricing

All prices are shown in Australian dollars.

Prices may change without notice. The price payable is the price displayed at the time your order is placed, unless there has been an obvious error.

Shipping, delivery or handling fees may apply and will be shown at checkout where applicable.

8. Payment

Payment must be made through the payment methods available on our website at checkout.

Your order will not be processed until payment has been successfully received.

9. Delivery and shipping

We will make reasonable efforts to pack plants carefully and dispatch orders within the timeframes stated on our website, where applicable.

Delivery times are estimates only and may be affected by weather, courier delays, public holidays, biosecurity requirements, high order volumes or other events outside our control.

You are responsible for providing a correct and complete delivery address. We are not responsible for loss, delay or damage caused by incorrect delivery information provided by you.

Where delivery tracking is provided, it is your responsibility to monitor the delivery and ensure someone is available to receive the order where required.

10. Collection, local pickup or local delivery

Where local pickup or local delivery is offered, details will be provided at checkout or by arrangement.

Orders must be collected within the agreed timeframe. If you do not collect your order within a reasonable time, we may contact you to arrange a new pickup time, cancel the order, or apply reasonable holding conditions depending on the circumstances.

11. Interstate orders and biosecurity restrictions

Plants may be subject to Australian state and territory biosecurity laws, quarantine rules or movement restrictions.

It is your responsibility to ensure that plants ordered from us can legally be received in your state, territory or location.

We may refuse, cancel or refund orders where we believe delivery may breach biosecurity rules, quarantine restrictions or courier requirements.

We are not responsible for loss, seizure, delay, destruction or additional costs caused by biosecurity restrictions, quarantine inspections or incorrect delivery locations supplied by the customer.

12. Returns, refunds and Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a repair, replacement, refund or other remedy if a product fails to meet a consumer guarantee.

Nothing in these Terms & Conditions limits or excludes any rights you have under Australian Consumer Law or any other applicable law.

Because plants are living products, we generally do not offer refunds or exchanges for change of mind, incorrect choice, failure to follow care instructions, unsuitable growing conditions, neglect, weather exposure after delivery, overwatering, underwatering, repotting damage, pruning damage, pest issues arising after receipt, or general decline after the plant has entered your care.

This does not limit any rights you may have under Australian Consumer Law.

If you believe your order was damaged, incorrect, not as described, or otherwise faulty at the time of delivery or collection, please contact us as soon as possible with your order number, photos and a description of the issue.

We will assess the matter fairly and provide a remedy where required by law.

13. Damaged or incorrect items

If your order arrives damaged or you receive the wrong item, please contact us as soon as possible after receiving the order.

Please include:

  • your order number;

  • clear photos of the plant, product and packaging;

  • a description of the issue; and

  • your preferred contact details.

We may request further information to assess the issue.

Depending on the circumstances and your rights under Australian Consumer Law, we may offer a replacement, refund, store credit or other appropriate remedy.

14. Care after delivery or collection

Plants should be unpacked promptly after delivery and placed in suitable conditions.

You are responsible for caring for the plant after it has been delivered or collected. This includes appropriate watering, drainage, light, temperature, humidity, pest control, fertilising, repotting and protection from weather extremes.

We are happy to provide general care guidance where possible, but responsibility for ongoing plant care rests with the customer once the plant has been received.

15. Weather and transport risk

We may delay dispatch during extreme heat, cold, storms or other conditions where we believe shipping may put plants at unreasonable risk.

Although we take care in packing orders, plants may experience some stress during transport. Minor leaf drop, wilting, soil movement, small broken leaves, minor cosmetic damage or temporary stress may occur and does not necessarily mean the plant is faulty.

16. Plant Breeder’s Rights and protected varieties

Some plant varieties may be protected under Plant Breeder’s Rights or other intellectual property rights.

Unless we expressly state otherwise, purchasing a plant from us does not give you permission to commercially propagate, reproduce, sell, distribute or exploit protected varieties.

You are responsible for complying with any applicable Plant Breeder’s Rights, trademarks, labels, licences or restrictions attached to a plant variety.

17. Pest and disease

We take reasonable care to supply healthy plants. However, plants are natural products and may occasionally carry minor pests, eggs, spores or other issues that are not visible at the time of sale.

We recommend inspecting all plants on arrival and isolating new plants before placing them with existing collections, especially bonsai, indoor plants, rare plants or valuable specimens.

18. Website content

All content on this website, including text, images, logos, branding, graphics, product descriptions, care guides and other materials, belongs to Viators Nursery or is used with permission.

You must not copy, reproduce, modify, distribute or use our website content for commercial purposes without our written permission.

19. User conduct

You agree not to use our website for any unlawful, harmful, misleading, abusive, fraudulent or disruptive purpose.

You must not attempt to interfere with the operation, security or functionality of the website.

20. Third-party services

Our website may use third-party services, including Shopify, payment processors, delivery providers and apps.

We are not responsible for third-party websites, platforms, payment systems, courier systems or services that are outside our control.

Your use of those services may also be subject to their own terms and policies.

21. Limitation of liability

To the maximum extent permitted by law, Viators Nursery is not liable for indirect, incidental, special or consequential loss, including loss of profits, loss of business, loss of opportunity, loss of plant collections, or loss resulting from improper care, unsuitable growing conditions or customer handling.

Nothing in this clause limits your rights under Australian Consumer Law.

22. Privacy

We collect and use personal information to process orders, communicate with customers, deliver products, manage our website and operate our business.

For more information, please refer to our Privacy Policy.

23. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time.

The version published on our website at the time of your order will apply to that order.

24. Governing law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

By using this website or placing an order, you agree that any dispute will be handled in accordance with the laws of New South Wales and Australia.
